A job offer is a job proposal offered to you by a Canadian employer. You may deal with the subject of a job offer in Canada in two different situations:

  • Immigration to Canada through a Canadian work visa and work permit.
  • Immigration to Canada through permanent residency immigration programs such as Express Entry.

In the Express Entry system, obtaining a job offer from Canada helps you increase your points in the CRS system.

Conditions of a job offer in Canada

A job offer must include information such as the employer’s name and address, employer’s job title, company name, applicant’s name, proposed job title, job description, start date, remuneration, deductions, working hours, and job benefits.

The first condition of a job offer in Canada is its validity. According to the Immigration, Refugees, and Citizenship Canada (IRCC) law, if a job offer is not valid, there is no possibility of obtaining a work visa or being eligible for points in the Express Entry system. The conditions of a valid job offer are as follows:

  • The job offer must be full-time, meaning at least 30 hours per week.
  • It must not be seasonal.
  • Its minimum duration must be one year.
  • It must have a positive Labour Market Impact Assessment (LMIA) from Employment and Social Development Canada, or be exempt from the LMIA requirement.

What should employers pay attention to in order to obtain a valid job offer from Canada?

  • Before hiring foreign applicants, employers are required to offer the job to Canadian labor forces, meaning individuals who are citizens or permanent residents of Canada, as they have priority in employment.
  • Employers must advertise the desired job for a minimum of 4 consecutive weeks.
  • For high-income jobs, employers must advertise the job in three different sources such as newspapers or reputable job websites. For low-income jobs, advertising in five reputable sources is recommended.
  • If after 4 weeks from the date of job advertisement, the employer fails to hire a Canadian citizen or permanent resident, they can apply for an LMIA from Employment and Social Development Canada.
  • Employers must submit the request for LMIA approval no later than three months after the start of job advertisement.
  • The salary for the proposed job cannot be lower than the standard wage for that job. Therefore, employers must pay an equivalent or higher salary than the average wage for that job in Canada.

Which employers are not eligible to offer a job offer to applicants?

Embassies or high authorities in Canada, employers listed as unauthorized employers for job offers, and employers who have recently started their business cannot offer a job offer to applicants.

Documents required to obtain a job offer:

Employers may request certain documents from you to assess your suitability for the desired position. While not all employers request the same documents, typically you should have the following documents prepared:

  • Resume: A professional and detailed resume outlining your educational, employment, research (if any), skills, and expertise.
    • If you’ve worked on specific projects within your field, provide detailed descriptions of those projects.
    • If you’re proficient in specialized software relevant to your field, mention them.
    • If you’re a member of relevant professional associations, provide details about them.
  • Recommendation letter(s) or employment letter from previous employers: Canadian employers may request a letter of employment or recommendation letter from previous employers to verify the information provided in your resume’s employment history section.
  • Business documents if self-employed in your country
  • Samples of designs or job projects (Portfolio)
  • Academic transcripts

Canada Job Offer Visa (Work Permit):

The Canada Job Offer Visa, or Work Permit, is a temporary work visa issued through obtaining a job offer from a Canadian employer. With this visa, you can enter Canada and work for a specified period for a designated employer. The biggest advantage of the Canada Job Offer Visa is the possibility of converting it into permanent residency in Canada.

Language Proficiency:

For obtaining a work visa through a job offer in Canada, you are not required to provide language proficiency documents. However, according to the regulations of Immigration, Refugees, and Citizenship Canada (IRCC), you must convince the officer that you have the necessary language skills to perform the duties assigned to you in your job offer. If the officer determines that you lack the ability to perform the work, there is a possibility of rejection due to language deficiency.

Financial Capability for Obtaining a Canada Job Offer Visa:

To obtain a work visa, you must prove to the officer that you have the financial capability to support yourself and your family for 12 months. Officers use the Low-Income Cut-Off (LICO) table to calculate this amount. For your convenience, the table is provided here.

Obtaining permanent residency in Canada through a job offer:

As mentioned at the beginning of this article, with a job offer visa (work permit), you can enter Canada and work for a specific employer.

There are different methods for obtaining permanent residency in Canada through a job offer:

  1. Express Entry: In the Express Entry system, which includes the Federal Skilled Worker (FSW), Canadian Experience Class (CEC), and Federal Skilled Trades (FST) programs, having a job offer is not necessary. However, having a job offer increases your points in the Comprehensive Ranking System (CRS).
  2. Provincial Nominee Programs (PNP): In some immigration pathways under provincial programs such as Ontario, having a job offer is mandatory. Therefore, having a job offer not only meets the requirements for these provincial programs but also facilitates the process of applying for provincial programs and obtaining permanent residency in Canada.

Conditions for a Valid Job Offer in the Canada Express Entry System:

To utilize your job offer for gaining additional points in the Express Entry system, the job offer must be:

  • Newly issued and less than one year old.
  • Clearly written and include details of the proposed job (job title, job duties, salary, deductions, and working hours).
  • Not issued by an embassy, consulate, or high commission in Canada.

Conditions for a Valid Job Offer for the Federal Skilled Worker (FSW) and Canadian Experience Class (CEC) Programs:

  • Issued by a single employer, continuous, and sequential, with payment for the job.
  • Full-time (minimum of 30 hours per week) and not seasonal.
  • Valid for at least one year from the date of permanent residency visa issuance.
  • Listed in Canada’s job NOC codes at skill levels 0, 1, 2, or 3.
  • For jobs requiring an LMIA, the employer must obtain a new positive LMIA confirming your job offer, with your job title and position stated. Otherwise, the job offer must be LMIA-exempt.

Conditions for a Valid Job Offer for the Federal Skilled Trades (FST) Program:

  • Issued by up to two employers, continuous, and sequential, with payment for the job.
  • Full-time (minimum of 30 hours per week) and continuous.
  • Valid for at least one year.
  • For technical and trade jobs listed in NOC skill levels 2 or 3 and assigned specific NOC codes. (List of technical jobs)
  • For jobs requiring an LMIA, the employer(s) must obtain a new positive LMIA confirming your job offer, with your job title and position stated. Otherwise, the job offer must be LMIA-exempt.

In the Express Entry program, the points you can earn through a job offer depend on the NOC code of the proposed job. Depending on the skill level of the proposed job, you can earn either 200 or 50 points:

  • 200 points: For jobs starting with NOC code 00.
  • 50 points: For all other jobs with skill levels in NOC classifications TEER 0, 1, 2, or 3.

Ontario Invitation to Applicants with Job Offers

Some provinces in Canada have immigration pathways that require a job offer. Ontario, in recent months, has issued invitation letters through several immigration pathways to applicants with job offers in Ontario. These immigration pathways are designed to address labor shortages in certain regions of Ontario and directly lead individuals to permanent residency.

Two immigration pathways that the province of Ontario has announced for individuals with job offers include the Foreign Workers Stream and the In-Demand Skills Immigration Stream. Each of these pathways has specific requirements based on the level of work experience and the type of job offered. Invitations are issued to applicants who have profiles in the Expression of Interest system. Subsequently, invited individuals register for the Ontario Regional Immigration Pilot.
